Terms & Conditions

1.1. NOIR BLANC 0.9. The sole proprietorship established in Amsterdam, The Netherlands, operating under the name Noir Blanc 0.9.

1.2. Website. The website of NOIR BLANC 0.9, accessible via www.noirblanc09.com and all associated subdomains.

1.3. Customer. Any natural person or legal entity that enters into an agreement with NOIR BLANC 0.9 and/or is registered on the Website.

1.4. Agreement. Any agreement concluded between NOIR BLANC 0.9 and the Customer, of which these General Terms and Conditions form an integral part.

2.1. These General Terms and Conditions apply to all offers, agreements, and deliveries of NOIR BLANC 0.9, unless expressly agreed otherwise in writing.

2.2. Any provisions deviating from these General Terms and Conditions shall only be binding if explicitly accepted in writing by NOIR BLANC 0.9.

2.3. If additional product- or service-specific terms apply alongside these General Terms and Conditions, the provision most favourable to the Customer shall prevail in the event of a conflict.

3.1. All prices stated on the Website include VAT and other applicable taxes, unless stated otherwise.

3.2. Shipping costs, where applicable, are clearly displayed before the Agreement is concluded and shown separately during the checkout process.

3.3. The content of the Website is composed with care. NOIR BLANC 0.9 does not guarantee that all information is complete or accurate at all times. Obvious typographical or technical errors do not bind NOIR BLANC 0.9.

3.4. NOIR BLANC 0.9 cannot be held responsible for colour deviations resulting from screen or display settings.

4.1. The Agreement is concluded at the moment the Customer accepts an offer from NOIR BLANC 0.9 and complies with the stated conditions.

4.2. Orders placed electronically are confirmed by email. Until confirmation of receipt is sent, the Customer may cancel the order.

4.3. NOIR BLANC 0.9 reserves the right to suspend or cancel an Agreement if incorrect or incomplete information has been provided.

5.1. Customers may create an account to make optimal use of the Website.

5.2. The Customer is responsible for choosing and safeguarding a secure password.

5.3. All actions performed through the Customer’s account are deemed to be performed by the Customer.

5.4. If the Customer suspects misuse of login credentials, they must immediately change their password and inform NOIR BLANC 0.9.

6.1. Orders are shipped without undue delay after receipt, subject to availability.

6.2. NOIR BLANC 0.9 is entitled to engage third parties for the fulfilment of its obligations.

6.3. Products are delivered within the stated delivery term or, if no term is specified, within 30 days at the latest.

6.4. If delivery is delayed, the Customer will be informed and may agree to a new delivery date or cancel the Agreement free of charge.

6.5. The risk of loss or damage transfers to the Customer upon delivery at the specified delivery address.

6.6. If an ordered product is no longer available, NOIR BLANC 0.9 may supply a comparable product. In such cases, the Customer may cancel the Agreement free of charge.

7.1. This article applies only to Customers acting outside a business or professional capacity.

7.2. The Customer has the right to withdraw from the Agreement within 14 days after receiving the product, without stating reasons.

7.3. The withdrawal period starts on the day after the Customer, or a designated third party, receives the product.

7.4. The costs of return shipping are borne by the Customer.

7.5. During the withdrawal period, the Customer shall handle the product and packaging with care. The product may only be used to the extent necessary to assess its nature and characteristics.

7.6. The Customer is liable only for any depreciation resulting from use beyond what is permitted.

7.7. Withdrawal may be communicated by email or in another unequivocal manner. NOIR BLANC 0.9 will confirm receipt of the withdrawal.

7.9. Refunds will be processed within 7 business days after the returned product has been received and inspected in good order.

8.1. The Customer must inspect the product upon delivery and report any defects within a reasonable time.

8.2. Complaints can be submitted via email to info@noirblanc09.com and will be handled promptly.

8.3. These terms do not affect statutory consumer rights.

9.1. NOIR BLANC 0.9 is only liable for direct damages caused by intent or gross negligence.

9.2. Liability is limited to the amount paid by the Customer under the Agreement.

10.1. All Agreements and these General Terms and Conditions are governed by Dutch law.

10.2. Any disputes shall be submitted to the competent court in The Netherlands.
